Availability

The terms and conditions are only valid for the following countries from where we accept orders on the Brewolution website:

Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Lithuania, Latvia, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden.

By purchasing Goods from the Brewolution website, you warrant that:

  • you are legally capable of entering into binding contracts
  • you are at least 18 years old
  • you are resident in and ordering Goods from one of the above countries

 

  1. Price

All prices shown on the website are in EUR and ex-warehouse in Them, Denmark. These prices include VAT but exclude delivery costs, which will be added to the total.

Shipping costs can be seen when you enter your address in checkout.

Accepted cards: Visa, Mastercard and Maestro.

Price terms

  • The price of any products will be as quoted in the Brewolution website from time to time, except in cases of obvious error.
  • These prices include VAT but exclude delivery costs, which will be added to the total amount.
  • Prices are liable to change at any time, but changes will not affect orders in respect of which already have sent to the buyer in the order confirmation.

 

The Brewolution website contains a large number of products and SKU’s. It is always possible that, despite our best efforts, some of the products listed and shown on the website may be incorrectly priced.

We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you an Order Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a mispricing.

Payment for all products must be made prior to order processing. We are under no obligation to deliver the Products until we have received payment.

We reserve the right to change the price if prices change on the ingredients, wages, loading costs or the rate of exchange among other things. 

 

  1. Consumer Rights

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the "Regulations") give you the right to cancel your Contract with us within 14 days without giving any reason.

The cancellation period will expire as follows:

  • For Goods, the period will expire after 14 days from the day you (or anyone nominated by you) receive(s) the Goods
  • In a Contract for the sale of multiple Goods with different delivery dates, the period will expire after 14 days from the day you (or anyone nominated by you) receive(s) the last of the Goods
  • To exercise the right to cancel, you must inform us of your decision to cancel the Contract by filling in the return form or a clear statement (for example, a letter sent by e-mail). For these purposes, see our contact details in the top of this page. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
  • If you exercise your above rights of cancellation but have received Goods in connection with the Contract, you shall send back the Goods or hand them over to us, without excessive delay and in any event not later than 14 days from the day on which you communicate your written cancellation of the Contract to us. The deadline is met if you send back the Goods before the period of 14 days has expired. You are required to return any Goods to us, at your own cost, to the return address we stipulate and in accordance with any instructions we give you.
  • You should take reasonable care of the Goods whilst they are in your possession. You are only liable for any diminished value of the Goods resulting from the handling of the Goods other than as required to establish the nature, characteristics and functioning of the Goods.

Goods are delivered with GLS or one of their partners in the respective country.

Shipping costs can be seen when you enter your address in checkout.

Risk and title

The Goods will be at your risk from the day you (or anyone nominated by you) receive(s) the Goods.

We make efforts to maintain storage of the in the pricelist mentioned items.

We strive to dispatch orderes within 1-2 business dags from the date of purchase.

If not in stock or by production, we state an estimated time of delivery. We are not obligated to replace any loss due to exceeded time of delivery. If we can supply the full order, we issue a back order. The back order is delivered as soon as possible or with the next order. If the buyer does not want a back order, then this is to be stated in writing.

 

  1. Delay

If our delivery is delayed without force majeure, the buyer is only justified to withdraw the order if the delay is 8 days or more.

 

  1. Personal data

Personal details provided to Brewolution through this website will only be used in accordance with our Privacy Policy. By using the Brewolution website, you consent to such processing of your personal data, and you warrant that all data provided by you is accurate.

  1. Inspection duties, complaint and returning

The buyer has 24 months right of complaint. The right to complain is limited or waived on food products, yeast and other products that have an expiry date. The buyer is obliged to check the delivery right after delivery is made. If buyer has any complaints these are made in writing by using the contact form at the website. If buyer does not complain the claim expires. The buyer is in that case obliged to exempt Brewolution from any claim.

The sold items can only be returned if this is made clear in a written agreement. Returned items must be undamaged and in the original packaging. Buyer pays for the freight of the returned items.

 

  1. Liability limitation

We are only responsible for our deliveries if buyer has used the items in accordance with the terms. Our responsibility is limited to errors in our deliveries. We are under no circumstance responsible for operations-, time-, profit-, or other losses by buyer or other users of our deliveries. The buyers claim can never be higher than the total amount of the contract/item, with the errors. We renounce widest possible extent of item responsibility that are tied to our deliveries. If we are met with claims about compensation for damage from buyers’ customer or third party, the buyer is obliged to exempt Brewolution from any such claim and cover our, within reason, costs with defending us against the claims.

 

  1. Payment

All payments are done by credit card.

The amount for the purchase is deducted from your account when the item is dispatched from our warehouse.

Right of ownership is in any concern that of Brewolution, until the payment has been made.

 

  1. Force majeure

Any circumstances beyond Brewolutions control, such as strike, fire, breakdown, lack of power, war or warlike states, governmental steps, absence or delays from sub suppliers, entitles us to delay delivery and entitle us to make a cancellation of the order without buyer can enjoin any compensation. Materiel and items in our stock at the time of the above-mentioned circumstances are ours to command over.

 

  1. Legal venue

If any disagreement between buyer and us, we make the right to decide whether the dispute is tried by arbitration or court. For both buyer and Brewolution the commercial court in Viborg serve as venue.

 

  1. Notices & Contact Information

All notices given by you to us must be given to Brewolution at the contact form at the website.

We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in the clause "Written Communications" above. Notice will be deemed received and properly served immediately when posted on the Brewolution website, 24 hours after an e-mail is sent, or five days after the date of posting of any letter.

In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and (in the case of an e-mail) that such e-mail was sent to the specified e-mail address of the addressee.

 

  1. Refunds Policy

If you cancel the Contract in accordance with the cancellation rights set out in the section above, we will reimburse to you all payments received from you, including the costs of delivery and return of the Goods. We will make the reimbursement without undue delay, and not later than (a) 14 days after the day we receive back from you the Goods supplied, or

(b) (if earlier) 14 days after the day you provide evidence that you have returned the Goods, 14 days after the day on which we are informed about your decision to cancel the Contract. We may withhold reimbursement until we have received the Goods back or you have supplied evidence of having sent back the Goods, whichever is the earliest.

If you wish to return Goods to us for any other reason (for instance, because have notified us in accordance with your Right to Vary), that you do not agree to any change in these terms of sale or in any of our policies or because you claim that the Product is defective), you must inform us in writing by using this Contact Form at the website.

You are required to return any Goods to us, at your own cost, to the return address we stipulate and in accordance with any instructions we give you. We will examine the returned Product or investigate your complaint and will notify you of your refund via e-mail within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund for the defective Product. Payments returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

We may make a deduction from the reimbursement for loss in value of any Goods supplied, if the loss is the result of unnecessary handling by you.

We do not offer VAT refunds for orders placed online on the Brewolution website. The price applicable is the price set out next to the product in question on the website on the date of ordering.

 

  1. Waiver

If we fail, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these terms of sale, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

A waiver by us of any default shall not constitute a waiver of any subsequent default.

No waiver by us of any of these terms of sale shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause "Notices & Contact Information" above.

Brewolution is making certain reservations in any tax changes, valuta changes, price changes/errors and proofreading errors, technical errors, out-of-stock items, and force majeure, including labor disputes and deficiencies in or delays in deliveries from sub-suppliers

 

  1. Our right to vary the terms and conditions

We have the right to revise and amend these terms and conditions from time to time.

Any Contract will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms of sale is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Order Confirmation (in which case we have the right to assume that you have accepted the change to the terms of sale, unless you notify us to the contrary within seven working days of receipt by you of the Products).

The language of the contract shall be English or Danish.

1. Price
The prices in this pricelist are a guidance, without tax and other. We reserve the right to change the price if prices changes on the ingredients, wages, loading costs or the rate of exchange among other things.  At smaller quantities the whole pallets the EUR pallet will be invoiced with 60 DKK a piece, but other wrapping is free of charge. Established customers will at any time be able to follow the prices at www.brewolution.com 

 

2. Change of order
Any change in the specifications of the order or the terms of delivery will only be accepted if the order is not under way by us or our supplier, accept of annulment or changes must be accepted in written terms by us.

 

3. Delivery
Agreed individually with each customer.

 

4. Time of delivery
We make efforts to maintain storage of the in the pricelist mentioned items, that dispatch happens within 1-3 workdays from receival of the order. If not in stock or by production, we state an estimated time of delivery. We are not obligated to replace any loss due to exceeded time of delivery. If we can supply the full order, we issue a back order. The back order is delivered as soon as possible or with the next order. If the buyer does not want a back order, then this is to be stated in writing

 

5. Delay
If our delivery is delayed without force majeure, the buyer is only justified to withdraw the order if the delay is 8 days or more. The buyer is only justified to compensation, if we have made gross negligence on our part of the deal.

 

6. Buying duties
At customer specific items we dispose over the raw material based on the buyers forecast, the buyer is bound to buy the raw material and finished items within the agreed time.

The buyer is obliged to check the delivery right after delivery is made. If buyer has any complaints these are made in writing. If buyer does not complain the claim expires. If buyer receives complaints from his/her customers, then buyer must make these in writing to us. If buyer does not meet these terms, the claim expires. The buyer is in that case obliged to exempt Brewolution from any claim.
The supplied item is nonreturnable. The sold items can only be returned if this is made clear in a written agreement. Returned items must be undamaged and in the original packaging. Buyer pays for the freight of the returned items.
